Your cover
Your insurance policy consists of the policy booklet and your Schedule and is
based on the information you provided to us when you took out the policy. You
must tell us of any change in this information as soon as possible for your
policy to continue to be valid.
Please read your Schedule and the booklet carefully to make sure that they give
you the cover you need and contact us if you have any problems or questions.
We will insure you for events occurring during the period of insurance in the
terms set out in your policy in return for payment of the premium.
Unless we have agreed otherwise, this contract will be governed by English Law.
Your Money–Back Guarantee
If this policy does not meet your needs and you notify us of this in writing
within 14 days of us sending you the policy, we will cancel the cover and refund
any premium paid, as long as you have not made a claim.
If we have not provided you with all the information we are required to give you
as a member of Financial Services Authority (FSA) (and you have not told us you
do not want it) you may cancel the policy within 14 days and get your money
back, as long as you have not made any claims against the policy.
Changing your cover or personal details
If you need to change your cover in any way or have any queries about your policy please contact us by telephone on 0870 240 2335.
Alternatively, notify us in writing, should you prefer, at the correspondence address shown on page five of the booklet.

When you need to claim against Sections 1-6 of your policy
If you phone to tell us you need to claim we will take down all the
details you give us, tell you what the next steps are and if you need to
do anything.
If you write to tell us you need to claim we will reply immediately if possible, but always within
5 working days.
We will explain to you how the claim will be settled, and settle it in the shortest possible time.
We will let you know quickly if anything is not covered and why.
We will always make every effort to meet the high standards we have set, but if you ever feel we have fallen
short of what you expect, or are dissatisfied in any other way, then please contact us first at: Customer

If this does not resolve matters for you then please write to the Managing Director, at the same address.
If you are dissatisfied with services under Section 7: Legal expenses, please contact our Customer Care

If you are still not satisfied you may refer the matter to the Financial Ombudsman Service (FOS).
This service is free to you and any decision they make is binding upon us. The FOS can be contacted on
0845 080 1800 or you can write to them at Insurance Division, Financial Ombudsman Service, South Quay Plaza,
183 Marsh Wall, London, E14 9SR.
If you do take these actions, your legal rights will not be affected.
Making a claim
If you need to make a claim, these are the main steps you need to follow:
Check your policy booklet and schedule which gives details of what is covered and read the detailed
claims procedures and conditions on page 30.
Inform the police straight away in the case of malicious damage, theft, attempted theft, or accidental
loss outside of the home and obtain the crime reference number.
For new claims, telephone 0870 240 2335 as soon as possible and provide
us with details of what has happened. We will then seek to resolve your claim as quickly as we can.
Once you have told us about your claim, we can provide support if you need further advice.
Please do not make any repairs without talking to us first, unless they are urgent to prevent further
damage, or throw away any damaged goods without our consent because we may need to see them. If you do
not allow us an opportunity to inspect your damaged property it may affect your claim. This does not
apply to spoiled food which can be disposed of as soon as a list has been made of the damaged items.
Please note that on most claims you pay the first £50 (or any different amount shown in your schedule)
of each claim or series of claims arising from one event causing property damage or loss. This helps us
to manage the claim costs and keep your premium down to a minimum.

Words phrases and special meaning
Whenever the following words and phrases appear in the Policy in bold print they will always have these meanings.
Accidental breakage
Breakage caused suddenly by external means which is not expected and not deliberate.
Accidental damage
Damage caused suddenly by external means which is not expected and not deliberate.
Appointed representative
The lawyer, accountant or other suitably qualified person who has been appointed to act for you or your family in accordance with the terms of this section.
British Isles
England, Scotland, Wales, Northern Ireland, Republic of Ireland, the Channel Islands and the Isle of Man.
Buildings
The structure of your home including its permanent fixtures and fittings and garden walls, gates, fences, paths, drives, patios, swimming pools and tennis courts in the grounds of your home.
Contents
Household goods, valuables and personal effects belonging to you or for which you are legally responsible.
Costs and expenses
- Legal costs
All reasonable and necessary costs chargeable by the appointed representative on a standard basis. Also the costs incurred by opponents in civil cases if you or your family has been ordered to pay them, or pays them with our agreement. - Accountants costs
A reasonable amount in respect of all costs reasonably incurred by the appointed representative.
Date of occurrence
- For civil cases (except under section 7e – Tax protection), the date of occurrence is the date of the event which may lead to a claim. If there is more than one event arising at the same time or from the same cause, the date of occurrence is the date of the first of these events.
- For criminal cases, the date of occurrence is when you or your family began or is alleged to have begun to break the criminal law in question.
- For full enquiries, the date of occurrence is when the Inland Revenue first notifies in writing the intention to make enquiries.
Domestic staff
Any domestic staff you or your family employ under a contract of service to work in or around your home.
Excess
The first amount of each claim you have to pay. If you make a claim under more than one section for loss or damage which happens at the same time by the same cause, we will take off only one excess.
Family
Your spouse or partner and children (including adopted and foster children) and any other relatives all permanently living with you.
Full enquiry
An extensive examination by the Inland Revenue which considers all aspects of you or your family’s tax affairs, but not enquiries which are limited to one or more specific aspects of you or your family’s self-assessment tax return.
Home
The private dwelling shown in your schedule and its garages, outbuildings, sheds and greenhouses, all owned or used by you for private and domestic purposes only. The main building of the home itself must be built of brick, stone or concrete and roofed with slates, tiles, metal, asbestos, asphalt or concrete unless we have agreed otherwise.
Household
Your family and domestic staff.
Money
Cash, currency notes, bank notes, money orders and current postage stamps, cheques, savings and trading stamps, savings certificates and savings bonds, luncheon vouchers, travellers cheques, travel tickets, and phonecards all held for social and domestic purposes.
Period of insurance
The period shown in your schedule and any further period for which you have paid or have agreed to pay and we have accepted or have agreed to accept your premium.
Personal belongings
Articles normally worn, used or carried about the person in everyday life including sports equipment, musical instruments and mobile telephones.
Schedule
The Home Insurance Policy Schedule which tells you the Sections of the booklet under which you are covered, the period of insurance, and provides other important details about the cover provided by your policy. It is enclosed with and forms part of your policy. Please check to see that it provides the cover you need.
Services
Cables and underground pipes and drains (and their inspection covers) serving your home and for which you are legally responsible.
Territorial limit
For sections 7a, d, e and f.
The United Kingdom of Great Britain and Northern Ireland, the Isle of Man and the Channel Islands.
For sections 7b and c..
The European Union, the Isle of Man, the Channel Islands, Albania, Andorra, Bosnia Herzegovina, Bulgaria,
Croatia, the Czech Republic, Gibraltar, Hungary, Iceland, Liechtenstein, Macedonia, Malta, Monaco, Montenegro,

Unfurnished
Not having enough furniture for normal living purposes.
Unoccupied
Not lived in or not intended to be lived in for more than 30 consecutive days.
Valuables
Jewellery, articles of precious metal, precious stones, clocks, watches, photographic equipment, furs, pictures, works of art, and collections of stamps, coins and medals.

We will pay the cost of rebuilding or repairing the part of your home which is damaged but not more than the cost of completely rebuilding it in its original form. If we instruct any tradesman, we will do so on your behalf. We will not make a deduction for wear and tear or depreciation if the buildings are maintained in a good state of repair. We do have the option of giving you a cash payment instead of repairing or rebuilding your home if your home cannot be economically repaired or you elect not to repair the damage. We will cover the insured in this section as long as:

Any claim reported to us more than 180 days after you or your family should have known about
the insured incident. Any incident or matter arising before the start of this policy. Any costs and expenses incurred before our written acceptance of a claim. Fines, penalties, compensation or damages which you or your family is ordered to pay a court or other authority. Any insured incident intentionally brought about by you or your family. Any claim relating to you or your family's alleged dishonesty or alleged violent behaviour. Any claim relating to written or verbal remarks which damage you or your family's reputation. A dispute with us not otherwise dealt with under condition 7 page 32. An application for Judicial Review. Any legal action you or your family takes which we or the appointed representative have not agreed to, or where you or your family does anything that hinders us or the appointed representative. Any claim relating to any non-contracting party's right to enforce all or part of this section. The Contracts (Rights of Third Parties) Act 1999 does not apply to this section. Any claim directly or indirectly caused by or resulting from any device failing to recognise, interpret, or process any date as its true calendar date. |

Contract disputes We will negotiate for the following: a. you and your family's legal rights in a contractual dispute arising from an agreement or an alleged agreement which you and your family has entered into for: the buying or hiring in of any goods or services: or the selling of any goods b. your legal rights in a contractual dispute or for misrepresentation arising from an agreement or alleged agreement which you have entered into for the buying or selling of your principal home. Provided that: You and your family has entered into the agreement or alleged agreement during the period of insurance. The amount in dispute is more than £100. |

Legal defence We will defend you or your family's legal rights if an event arising from you or your family's work as an employee leads to: a. you or your family being prosecuted in a court of criminal jurisdiction; b. or civil action being taken against you or your family under legislation for unlawful discrimination on the grounds of sex, race, disability, religious belief or political opinion; c. or civil action being taken against you or your family under section 13 of the Data Protection Act 1998. |

This is the procedure you should follow in the event of a claim or something happening which may give rise to a claim. If you do not follow this procedure you will break a Condition of the Policy. This may invalidate your claim. Remember! If you make a claim under the policy which is false or fraudulent in any respect, we will not pay the claim and all cover under the policy will cease.
Reporting a claim If, following a claim under the Policy, you receive a claim form or any form of notice of legal proceedings against you, you must send this as soon as possible to the Goldfish Home Insurance Claims Department, by recorded delivery and quoting your claim or policy reference. You must give us all the help and information necessary to settle or resist any claim made against you or help us begin proceedings against any other person.

Any loss or reduction in market value resulting from the repair or replacement of lost or damaged property or any loss or damage which results indirectly from anything insured by this policy.
